These Terms and Conditions govern the supply of drainage services by Davis Drain Services (“we”, “us”, “our”) to any person or business who requests, books or receives those services (“you”, “the customer”). By booking a job, accepting a quotation, or allowing us to attend your property, you accept these Terms.

Services means any drainage work we carry out, including drain unblocking, drain cleaning, high pressure jetting, CCTV camera surveys, odour investigation, root cutting, pipe patching and re-lining, electronic pipe tracing and mapping, tanker services, excavation work, grease trap cleaning and maintenance, rodent investigation, septic tank and bio cycle maintenance, site suitability testing, and planned and preventative maintenance.
Site means the property or location at which the Services are carried out.
Quotation means a written price issued by us for a defined scope of work.
Callout means an attendance at Site to diagnose and, where possible, resolve a drainage problem.
2.1 A quotation is valid for 30 days from the date of issue unless stated otherwise in writing.
2.2 A quotation is based on the information supplied by you and, where applicable, on what is visible or accessible at the time of inspection. Drainage systems are largely concealed. Where the work uncovers conditions that could not reasonably have been identified beforehand, including collapsed pipework, illegal or undocumented connections, root ingress, or material not permitted in the system, we will inform you and issue a revised price before continuing.
2.3 Verbal estimates given over the phone are indicative only and are not binding.
2.4 Prices are exclusive of VAT unless stated otherwise. VAT is charged at the rate applicable on the date of invoice.
3.1 A booking is confirmed once we accept your instruction by phone, email or in writing.
3.2 Our emergency line is answered 24 hours a day, 365 days a year. Response times quoted refer to the time taken to answer and respond to your call. They are not a guaranteed arrival time at Site. Arrival depends on traffic, weather, crew availability and the location of the Site.
3.3 Callout charges, out of hours rates and minimum charges apply as advised at the time of booking. [CONFIRM CALLOUT AND OUT OF HOURS CHARGING STRUCTURE]
3.4 A callout charge is payable where we attend Site as instructed, whether or not the problem is resolved on that visit, and whether or not the cause is found to be outside our scope of work.
4.1 You must provide safe and unobstructed access to the Site, to all drains, manholes, chambers, grease traps, tanks and inspection points relevant to the work, and to a water supply and electricity where the work requires it.
4.2 You must tell us in advance of anything at the Site that may affect the safety or delivery of the work, including buried services, private wiring, asbestos, unstable ground, previous drainage alterations, or restricted access.
4.3 Where we cannot begin or complete the work because access is not available, because the Site is unsafe, or because nobody is present to allow entry, we may charge for the attendance and for any wasted time.
4.4 You must confirm that you own the Site or are authorised to instruct work on it. Where a drain is shared, is a private common drain, or is the responsibility of a management company, a neighbour or the local authority, you remain responsible for our charges unless we have agreed in writing to invoice another party.
4.5 You must move or protect vehicles, furniture, stock and personal belongings from the working area before we arrive.
5.1 We carry out the Services with reasonable skill and care, using trained operatives and appropriate equipment.
5.2 Unblocking work aims to restore flow. It does not repair the underlying condition of the drain. Where a blockage recurs because of a structural defect, root ingress, incorrect falls, or continued misuse of the system, further chargeable work will be required.
5.3 High pressure jetting is carried out at pressures appropriate to the pipework we can identify. Older, damaged, poorly bedded or previously repaired pipework can fail under normal cleaning pressures. We are not liable for failure of pipework that was already defective or at the end of its serviceable life, provided the work was carried out with reasonable skill and care.
5.4 A CCTV survey records the condition of the drain as seen on the date of the survey, within the sections that can be accessed by the camera. Sections that cannot be entered because of blockages, collapses, bends, size changes or standing water are excluded and will be noted. A survey is not a warranty of the future condition or performance of the system.
5.5 Excavation work includes reinstatement of the excavated area to a safe and serviceable standard. An exact match of existing surfaces, including paving, tarmac, decorative finishes, planting and lawn, cannot be guaranteed. Where a specific finish is required, it must be agreed and priced in writing before work begins.
5.6 We are not responsible for pre-existing damage, for the condition of the system away from the area we worked on, or for defects caused by the actions of other parties.
5.7 Where the cause of a problem lies outside your property boundary or within a public sewer, responsibility may rest with the water utility or local authority. We will tell you where this appears to be the case. Our charges for attendance and diagnosis remain payable.
6.1 Waste, sludge, effluent and grease removed from Site is handled and disposed of in line with applicable waste management legislation, and only at authorised facilities.
6.2 Tanker, grease trap, septic tank and bio cycle services are priced on the volume and type of material removed. Where the volume or the nature of the material differs from what was described at the time of booking, charges will be adjusted accordingly.
6.3 You confirm that no hazardous, chemical, clinical or prohibited waste has been discharged into the system. Where such material is found, work may be stopped and additional charges for specialist handling and disposal will apply.

7.1 Payment for domestic work is due on completion unless credit terms have been agreed in writing.
7.2 Where account terms have been agreed, invoices are payable within [PAYMENT TERMS, e.g. 30 days] of the invoice date.

7.4 Late payment on commercial contracts carries interest and compensation in line with the European Communities (Late Payment in Commercial Transactions) Regulations.
7.5 Where payment is outstanding, we may withhold reports, survey footage and certificates, suspend further work, and recover reasonable costs of collection.
7.6 Deposits may be required for excavation, lining, planned maintenance and other scheduled works. [CONFIRM DEPOSIT POLICY]
8.1 Where you are a consumer and the contract is agreed away from our business premises or at a distance, you have the right to cancel within 14 days without giving a reason, under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.
8.2 If you ask us to begin work during the 14 day cancellation period, and you then cancel, you must pay for the work carried out up to the point of cancellation.
8.3 Where you specifically request an urgent visit for repair or maintenance work, the cancellation right is limited as provided for in those Regulations.

8.6 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2022.
9.1 Workmanship on completed repair and installation work is guaranteed for [GUARANTEE PERIOD] from the date of completion. [CONFIRM GUARANTEE PERIOD AND SCOPE]
9.2 The guarantee covers our workmanship only. It does not cover recurrence caused by misuse, by items that should not be put into a drainage system, by root growth, by ground movement, by third party work, or by defects elsewhere in the system that were reported to you and not repaired.
9.3 Unblocking and cleaning are maintenance services and are not guaranteed against recurrence.
9.4 Manufacturer warranties apply to supplied parts and materials and are passed to you where applicable.

10.2 We are liable for loss or damage caused by our negligence or by our failure to carry out the Services with reasonable skill and care.
10.3 We are not liable for loss or damage that was not caused by our work, including pre-existing defects, consequential flooding from a system already in failure, or damage arising from concealed pipework or services whose position was not disclosed to us and could not reasonably have been identified.
10.4 Except in the case of death or personal injury caused by our negligence, or any other liability that cannot be excluded by law, our total liability in connection with any job is limited to the value of the charges paid for that job.
10.5 We are not liable to business customers for loss of profit, loss of business, loss of contracts or other indirect or consequential loss.
10.6 Neither party is liable for delay or failure caused by events outside its reasonable control, including severe weather, flooding, utility failure, road closures or industrial action.
11.1 If you are unhappy with any part of the Services, contact us on (01) 849 1706 or at info@davisdrainservices.ie with the job details and the date of the work.
11.2 We will acknowledge your complaint within [RESPONSE TIME] and give you a response following investigation.
11.3 You must give us a reasonable opportunity to inspect and, where appropriate, put right any alleged defect before engaging another contractor. Costs incurred with another contractor without giving us that opportunity will not be reimbursed.
We provide drainage services across north County Dublin, Meath, Louth and surrounding areas, including Skerries, Rush, Lusk, Balbriggan, Swords, Malahide, Portmarnock, Howth, Sutton, Donabate, Portrane, Ashbourne, Finglas, Glasnevin, Clontarf, Coolock, Raheny, Blanchardstown, Castleknock, Lucan, Palmerstown, Drogheda, Duleek, Laytown and Bettystown. Attendance outside our normal service area may carry an additional travel charge, advised at the time of booking.
13.1 We process personal data in line with the General Data Protection Regulation and the Data Protection Acts 1988 to 2018. How we collect and use your information is set out in our Privacy Policy.
13.2 CCTV survey footage and site photographs are retained as a record of the work carried out. Footage may be used for training and quality purposes. It will not be published or used in marketing in a way that identifies you or your property without your consent.
Survey reports, footage, drawings and mapping produced by us remain our property until paid for in full. Once paid, you may use them for the purposes of the Site. They may not be resold or reproduced for commercial use without our written consent.
15.1 These Terms are the entire agreement between us for the Services and replace any earlier discussion or correspondence.
15.2 If any part of these Terms is found to be unenforceable, the remaining parts continue to apply.
15.3 We may update these Terms from time to time. The version in force is the one published on this page on the date your booking is confirmed.
15.4 These Terms are governed by the laws of Ireland and the courts of Ireland have exclusive jurisdiction.
